Terms of service

1. Scope

These terms apply to the use of Nyx Bot, the dashboard at dash.nyxbots.com and the website nyxbots.com, operated by [name of the operator, see imprint]. Discord’s terms of service and community guidelines apply in addition.

2. Service

Free is available to every server without a subscription. Pro, Pro+ and Enterprise are subscriptions per server with the features and limits shown on the pricing page. Limits only exist where real costs occur; security features are never locked. We may change features of the free tier; we will announce changes to Pro features in the changelog.

3. Subscription and payment

Pro is bought per server, either inside Discord (Premium Apps) or on this website via Stripe, monthly or yearly. Prices are shown in US dollars; the checkout shows the final price including the statutory VAT of your country before you pay. The 14-day trial requires no payment details and ends automatically.

4. Cancellation

You can cancel at any time to the end of the paid period, in the dashboard, in Discord or with the cancellation button that will be reachable from every page (§ 312k BGB). After the end of the subscription your data stays, Pro features pause after a 7-day grace period.

5. Right of withdrawal

Consumers in the EU have a 14-day right of withdrawal for subscriptions bought on the website. [The withdrawal instruction and the model form follow with the Pro launch.]

6. Your obligations

You may use Nyx Bot only in accordance with Discord’s rules and applicable law. You are responsible for the configuration of your server, for the content of tags, messages and automations, and for informing your members about logging and message storage.

7. Availability and liability

We aim for high availability but do not guarantee uninterrupted operation; Discord outages are outside our control. Liability is limited to intent and gross negligence, except for damage to life, body or health and for claims under product liability law.

8. Changes and applicable law

We may update these terms; material changes are announced in the changelog and by notice in the dashboard at least 30 days before they take effect. German law applies; for consumers, the mandatory consumer protection rules of their country of residence remain unaffected.
